MITCHELL, SD – David Edward Petersdorf, 51, of Mitchell, South Dakota, dodged a potential prison sentence, receiving three years of probation for illegally possessing a handgun. The sentencing, handed down August 31, 2020, by U.S. District Judge Karen E. Schreier, highlights a continuing federal crackdown on firearms offenses.
Petersdorf was initially indicted by a federal grand jury on August 6, 2019, and ultimately pled guilty on June 8, 2020, to the charge of Felon in Possession of a Firearm. The case stemmed from a voluntary search of his residence on May 7, 2019. Petersdorf readily admitted to officers that a Springfield Armory, Model XD-9 Sub-Compact, 9mm handgun – legally shipped across state lines – would be found on the premises.
What Petersdorf conveniently failed to mention was his prior criminal conviction, a charge serious enough to warrant imprisonment exceeding one year. Knowing full well he was prohibited from owning any firearms, he still possessed the weapon, a blatant disregard for federal law. In addition to probation, Petersdorf was ordered to pay a $100 assessment to the Federal Crime Victims Fund – a pittance considering the potential danger his actions posed.
