Mexican Citizen Convicted of Trafficking Sentenced for Reentry

Madison, WI – In a shocking case of hypocrisy, Eli Torres-Banos, a 36-year-old Mexican citizen with a prior conviction for conspiracy to distribute 500 grams or more of cocaine, has been sentenced to serve 1 year in federal prison for illegally reentering the United States.

Torres-Banos, who pleaded guilty to the charge on March 15, 2024, had been removed from the country in 2010 following the completion of his prison sentence. However, on June 7, 2023, he was arrested for a misdemeanor traffic offense in Jefferson County, Wisconsin, and U.S. Immigration and Customs Enforcement discovered his illegal presence in the country.

On December 6, 2023, Torres-Banos was arrested again in Jefferson County, this time following his indictment in this case. During the arrest, law enforcement found 8.5 kilograms of cocaine in a vehicle associated with Torres-Banos, leading to a second indictment for the new charges. That case is scheduled to go to trial on September 23, 2024.

U.S. District Judge James D. Peterson ruled that Torres-Banos’s prior federal conviction was an aggravating factor in determining his sentence, stating that it weighed heavily in his decision.

The investigation that led to Torres-Banos’s indictment was conducted by U.S. Immigration and Customs Enforcement and the Jefferson County Sheriff’s Office, with Assistant U.S. Attorneys Steven P. Anderson and Steven C. Ayala prosecuting the case.

Torres-Banos is presumed innocent of the new cocaine charges unless proven guilty. As he begins his 1-year prison sentence, it remains to be seen whether this will be his last stint behind bars for his alleged transgressions.
