Chinese Nationals Sentenced for Smuggling Scheme

SAIPAN, GUAM – In a crushing blow to transnational crime, two Chinese nationals have been sentenced for their roles in a daring smuggling scheme that brought 12 foreign nationals to the United States, sparking outrage and raising serious concerns about national security.

According to the Department of Justice, USAO, DONGLIN XU, 49, and QINGLANG LI, 52, orchestrated a clandestine operation to transport themselves and 12 other Chinese nationals from Saipan to Guam via private watercraft, each contributing up to $5,000 to secure passage.

The brazen scheme ran afoul of federal law, which prohibits travel outside of the Commonwealth of the Northern Mariana Islands (CNMI) without proper authorization. Furthermore, most of the individuals involved had no lawful immigration status at the time of the offense.

On May 31, 2024, the United States District Court for the Northern Mariana Islands handed down the following sentences:

• DONGLIN XU, 49 – 12 months imprisonment, one year supervised release, 50 hours community service, $100 mandatory assessment.

• QINGLANG LI, 52 – 8 months imprisonment, one year supervised release, 50 hours community service, $100 mandatory assessment.

The district court also ordered the defendants to return to China within three months of serving their sentences of confinement, a move that was seen as a significant blow to the smuggling operation.

“We will continue to prosecute this conduct to hold offenders accountable and promote safety at sea,” stated United States Attorney Shawn N. Anderson, underscoring the severity of the crime and the need for stricter enforcement.

The case was investigated by Homeland Security Investigations and prosecuted by Eric S. O’Malley, Assistant United States Attorney in the District of the Northern Mariana Islands.

The sentencing marks a significant victory in the ongoing fight against human trafficking and transnational crime, sending a stern message to those involved in similar schemes: justice will be served, and those who engage in this heinous activity will face the full force of the law.
