Tampa, FL – The grim saga of illegal immigration and firearms violence took a dark turn as Olvin Javier Gutierrez Ponce (44, Bradenton) faced the music for his brazen act of unlawful possession of a firearm. United States Attorney Gregory W. Kehoe confirmed the return of an indictment charging Ponce with this serious offense.
Should Ponce be found guilty, he could be staring down a 15-year sentence in federal prison. The feds are not playing around; they aim to strip him of his Taurus and Springfield 9mm pistols, which they claim were procured through criminal proceeds.
The details of the indictment paint a picture of a man well aware of his illegal status yet unapologetically wielding weapons on American soil. In July 2025, Ponce, an alien who was both illegally and unlawfully in the United States, took possession of a firearm, according to the charges.
It’s important to note that an indictment is not a conviction; it merely serves as a formal charge that a defendant has violated federal criminal law. Ponce, like every defendant, is presumed innocent until proven guilty.
This case has been a collaboration between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO), and the Bradenton Police Department. Assistant United States Attorney Abigail K. King will be prosecuting this matter.
Operation Take Back America has been in full force here, a nationwide initiative that leverages all of the Department of Justice’s resources to combat illegal immigration, dismantle cartels, and protect communities from violent crime. Ponce’s case is yet another testament to the initiative’s commitment to safeguarding American neighborhoods.
