Jose Luis Ruiz-Gutierrez, Deported Alien Found in the United States, Nevada 2025
LAS VEGAS, Nevada - A Mexican national and a Honduran national were charged with one-count of deported alien found in the United States after they were apprehended in Las Vegas, Nevada.
Jose Luis Ruiz-Gutierrez, 39, and Samir Adrian Hernandez-Padilla, 39, both made their initial court appearances on Monday to face the charges.
Ruiz-Gutierrez, a citizen and national of Mexico, and Hernandez-Padilla, a citizen and national of Honduras, were both previously deported and removed from the United States and reentered the United States illegally.
According to allegations contained in the criminal complaints and statements made during court proceedings, Ruiz-Gutierrez, who had been arrested by officers from the North Las Vegas Police Department for four counts of Sex Assault Against Child Less Than 16 and Lewdness by Person Over 18 with Child Less Than 14, had previously been deported three times on or about February 15, 2011, May 3, 2011, and December 24, 2013.
Ruiz-Gutierrez has prior felony convictions for drug trafficking and deported alien found in the United States, the same offense he is currently charged with. If convicted, Ruiz-Gutierrez faces a maximum statutory penalty of 20 years in prison, a three-year term of supervised release, a $250,000 fine, and a $100 special assessment.
Hernandez-Padilla, who had previously been deported to Honduras on or about December 12, 2013, had been remanded to the custody of ICE on July 18, 2025, from the Nevada Department of Corrections, based on an ICE detainer. If convicted, Hernandez-Padilla faces a maximum statutory penalty of two years in prison, one-year term of supervised release, a $250,000 fine, and a $100 special assessment.
The ICE Salt Lake City, Las Vegas Sub-Office investigated the case, and the United States Attorney's Office for the District of Nevada is prosecuting the case.
A complaint is merely an accusation, and a defendant is presumed innocent unless and until proven guilty.
