Jose Arcadio Garduno-Gomez, 24, of Norristown, Pennsylvania, was indicted today on federal charges of illegal reentry after deportation, marking a violent return to U.S. soil nearly five years after being formally removed.
According to the indictment unsealed this morning, Garduno-Gomez, an alien native and citizen of Mexico, was found inside the United States on or about June 22, 2016 — despite having been legally deported on March 5, 2011. The charge, brought by United States Attorney Zane David Memeger’s office, cuts to the core of federal immigration enforcement failures.
Illegal reentry after deportation is a felony under U.S. law, and in this case, prosecutors are pushing for the maximum penalty. If convicted, Garduno-Gomez faces up to twenty years behind bars — a sentence meant to deter others from circumventing the immigration system.
The investigation was conducted by Immigration and Customs Enforcement’s Enforcement and Removal Operations (ICE ERO), the federal unit tasked with tracking down and apprehending deported nationals who slip back across borders.
