SIOUX FALLS, SD – Robert Wolfe Jr., 45, of Sisseton, South Dakota, is headed to federal prison for more than two years after a raid on his home turned up a rifle he wasn’t legally allowed to own. Chief Judge Roberto A. Lange handed down the 2.5-year sentence on March 13, 2026.
Roberts County deputies executed a search warrant at Wolfe’s residence back in April 2024, finding a Remington bolt-action rifle. The problem? Wolfe already had a felony conviction – a 2014 bust for possessing a controlled substance – which permanently barred him from owning firearms.
Wolfe pleaded guilty in November 2025 to possession of a firearm by a prohibited person. In addition to the prison time, he’ll face three years of supervised release, forfeit the rifle, and pay a $100 penalty to a fund for crime victims. He was immediately taken into custody by U.S. Marshals after sentencing.
The bust was a joint effort by the Roberts County Sheriff’s Office, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), and the FBI. Assistant U.S. Attorney Mark Joyce handled the prosecution.
Federal officials are framing the case as part of “Operation Take Back America,” a broad initiative aimed at tackling cartels, transnational crime, and – predictably – illegal immigration. It pulls resources from existing DOJ task forces like the Organized Crime Drug Enforcement Task Forces (OCDETF) and Project Safe Neighborhoods (PSN).
