NEW YORK – While Washington D.C. descends further into political gridlock, millions of Americans face a far more immediate crisis: the potential loss of food assistance. New York Attorney General Letitia James, alongside a coalition of 22 other state attorneys general, is turning up the heat on the Trump administration, demanding immediate action to protect Supplemental Nutrition Assistance Program (SNAP) benefits during the ongoing federal government shutdown. The stakes are stark – tens of millions could be left hungry if the administration doesn’t act.

The core of the battle centers around a recent directive from the U.S. Department of Agriculture (USDA), the agency responsible for administering SNAP. USDA notified states on October 10th that, should the shutdown continue, it lacks the funds to distribute November SNAP benefits. The order instructed states to delay issuing payments or sending files to vendors, citing “exploring contingency plans.” Attorney General James and her colleagues argue this directive is not only reckless but lacks any legal justification, potentially devastating vulnerable communities.

“No family should go hungry because of dysfunction in Washington,” James stated bluntly. “SNAP benefits are a lifeline for millions of Americans, including children, veterans, and seniors, who rely on this assistance to put food on the table. The USDA has both the funds and the authority to keep these benefits flowing, and I am calling on the agency to act immediately. My office will always stand up for working families and hold the federal government accountable when it fails to meet its most basic obligations.”

The numbers paint a grim picture. Nationwide, over 42 million Americans depend on SNAP to feed themselves and their families. Nearly 60 percent of SNAP recipients are children and seniors, with over a million veterans receiving benefits annually. In New York State alone, SNAP serves nearly three million people – individuals now directly threatened by the Trump administration’s budgetary maneuvering. The attorneys general point to the fact that USDA has access to at least $6 billion in contingency funds specifically appropriated by Congress for situations like this.

The coalition’s letter to the USDA stresses the agency has previously acknowledged these funds could be used to continue SNAP operations during lapses in appropriations. Despite this, the USDA has remained silent on how it intends to utilize these funds to prevent families from losing access to vital food assistance. The AGs aren’t asking for miracles, just a clear plan and a commitment to using available resources to avert a crisis.

Attorney General James and the coalition have given the USDA until October 28th to respond with a detailed explanation of its contingency plans, including whether it intends to issue full or partial November benefits and the legal basis for its directive to delay distributions. The clock is ticking, and with each passing day, the risk of widespread hunger grows. This isn’t just a political fight; it’s a fight for the basic sustenance of millions of Americans.
