SAN FRANCISCO, Calif. – Mark R. Maness, 65, of Spartanburg, South Carolina, is headed to federal prison after being sentenced to 41 months for his role in a brazen $228 million tax refund fraud. U.S. District Judge Susan Illston handed down the sentence today, along with an order for Maness to pay $1,176,668 in restitution to the Internal Revenue Service.

Maness pleaded guilty last November to one count of conspiracy to submit false claims. The scheme, operated through a company called O.I.D. Process, involved the preparation and filing of bogus U.S. Individual Income Tax Returns. Maness and an unnamed partner falsely claimed Original Issue Discount (O.I.D.) interest income and fabricated federal tax withholdings, all in a calculated effort to generate fraudulent refunds.

The scale of the operation was staggering. O.I.D. Process clients filed roughly 200 tax returns seeking a total of $228 million in illegitimate refunds. Maness didn’t work for free. Clients were hit with a non-refundable registration fee just to join the scheme, and then a hefty 20% “refund acquisition fee” – a cut of every fraudulent check the IRS coughed up.

The operation wasn’t confined to paperwork. Maness and his partner ran a website and held weekly conference calls, actively instructing clients on how to complete the fraudulent returns. Crucially, they directed clients to change their mailing addresses with the IRS to an address controlled by an attorney in San Francisco, ensuring Maness and his partner could intercept the checks and skim off their 20%.

The investigation was led by IRS-Criminal Investigation (IRS-CI), and the prosecution was handled by Tax Division Trial Attorney Matthew J. Kluge and Assistant U.S. Attorney Michael G. Pitman. Judge Illston also ordered Maness to serve an 18-month term of supervised release following his prison sentence.

This case serves as a stark reminder that those who attempt to defraud the U.S. government will be held accountable. The IRS-CI continues to aggressively pursue these schemes, protecting taxpayer dollars and ensuring the integrity of the tax system.
