N.Y. Cop Walks Free in Clements’ Death After Thorough Inquiry

New York Attorney General Letitia James’ Office of Special Investigation (OSI) has formally released its findings on the tragic death of David Clements, who was shot by a Nassau County Police Department (NCPD) officer last February. The OSI report states that after an exhaustive investigation involving body-worn camera footage, audio from emergency calls, and interviews with witnesses and involved parties, the OSI determined there would be insufficient evidence to disprove beyond a reasonable doubt that the officer’s use of deadly force was justified.

On February 2, 2024, NCPD officers responded to a call reporting a suicidal individual armed with a gun. When they encountered Mr. Clements outside his Massapequa home, he reportedly pointed multiple firearms at them, ignoring their commands to surrender. Following the officer’s discharge of his service weapon, Mr. Clements was pronounced dead on the scene. Three BB guns resembling real firearms were recovered at the crime scene.

According to New York’s justification law for police use of deadly force, an officer may respond with lethal force if they reasonably believe it is necessary to protect against the imminent threat of deadly physical force. OSI concluded that under these circumstances, there was no legal grounds to disprove the officer’s claim of self-defense in court.

Attorney General James emphasized the importance of transparency and accountability in such matters, stating, “Our investigation has been thorough and fair, and our decision reflects the weight of the evidence before us.” The OSI’s finding means that criminal charges will not be pursued against the officer involved.

The Clements case has drawn intense public scrutiny, with calls for greater clarity on police use of force policies. Critics argue that the OSI’s conclusion could leave a question mark over the justification for the use of lethal force in similar situations. Meanwhile, NCPD officials have expressed their condolences to the Clements family and noted the department’s commitment to ensuring the highest standards of professional conduct among its officers.
