WASHINGTON – In a move to bolster the efficiency of the banking industry, the Federal Deposit Insurance Corporation (FDIC) Board of Directors has approved a landmark final rule aimed at speeding up and simplifying the process of establishing and relocating domestic branches and main offices. This new regulation is set to slash red tape and regulatory burdens associated with branch and main office filings, marking a significant shift in financial industry operations.
The final rule, announced on December 16, 2025, closely mirrors a proposal issued in July 2025, with minor modifications for clarity and practicality. It applies to both insured state non-member banks seeking to establish a new branch or relocate an existing one, as well as to insured branches of foreign banks looking to change their location.
Key elements of the final rule include:
- Automatically approving most expedited filings three business days post-submission;
- Eliminating the FDIC’s ability to withdraw a filing from expedited processing;
- Easing requirements for minor branch facility changes, effectively doing away with the need for such filings;
- Simplifying the content of required filings;
- Removing public notice and public comment requirements; and
- Extending the expiration period for approved filings.
