Livingston Indicted for Burglary of Firearms Licensee in Roosevelt, Utah

SALT LAKE CITY – Raymond Michael Livingston, also known as Bobby and Michael, was unsealed with a three-count indictment in U.S. District Court for a brazen June 23, 2013, burglary at Stewart’s Ace Hardware in Roosevelt, Utah.

The 34-year-old suspect from Ballard, Utah, and Las Vegas, Nevada, is charged with possession of 18 stolen firearms and burglary of a federal firearms licensee. Livingston was also under Felony Information for forgery in Nevada when he allegedly possessed the stolen firearms from Utah.

Livingston made his initial appearance on Tuesday and entered not guilty pleas to the charges. His trial is set to begin July 21, 2014, before Judge David Nuffer, with a detention hearing scheduled for Wednesday at 9:30 a.m. in front of Magistrate Judge Evelyn J. Furse.

Five of the stolen firearms have been recovered by the Las Vegas Metro Police Department during criminal investigations.

The maximum penalty for Livingston’s charges includes 10 years in prison and a $250,000 fine. Receiving firearms while under Felony Information carries a potential five-year sentence. Indictments are not findings of guilt; Livingston is presumed innocent until proven guilty.

ATF special agents are investigating the case, which is part of the U.S. Attorney’s Office in Salt Lake City’s Utah Project Safe Neighborhoods initiative aimed at curbing gun violence in Utah communities.
