Buffalo Man Charles Newkirk, 33, Arrested in Heroin, Fentanyl Bust

Charles Newkirk, 33, of Buffalo, NY, is behind bars on federal charges tied to a steady flow of heroin and fentanyl into the city’s underground markets. Arrested this week on a criminal complaint, Newkirk faces a maximum of 20 years in prison and a $1,000,000 fine for conspiracy to possess with intent to distribute the deadly narcotics.

Acting U.S. Attorney James P. Kennedy, Jr. confirmed the arrest, laying out a case built on undercover operations and forensic drug testing. According to the complaint, Newkirk allegedly moved large volumes of heroin through Buffalo’s streets, fueling the ongoing opioid crisis in Western New York.

The takedown stems from two controlled buys orchestrated by a confidential source. On June 25, 2015, and again on July 7, 2015, the informant purchased substances from Newkirk believed to be cocaine. Lab analysis later confirmed the drugs contained both heroin and fentanyl — a potent synthetic opioid responsible for countless overdose deaths across the region.

Assistant U.S. Attorney Meghan Tokash, leading the prosecution, said the evidence paints a clear picture of a dealer operating with dangerous intent. “This wasn’t casual use or petty dealing,” Tokash stated. “We’re talking about the distribution of lethal substances that have devastated communities.”

Newkirk appeared before U.S. Magistrate Judge Michael J. Roemer for initial proceedings, as federal authorities move to tighten the case ahead of trial. If convicted, he’ll face a mandatory minimum sentence under federal sentencing guidelines for drug distribution resulting in serious bodily harm or death, though no such enhancement has been filed yet.

The investigation was conducted by the Drug Enforcement Administration’s New York Field Division, under the direction of Special Agent-in-Charge James J. Hunt. Authorities warn that the presence of fentanyl-laced street drugs continues to pose a lethal threat to users and first responders alike. The case remains ongoing.
