PITTSBURGH, PA – Donald Smith, 75, is looking at serious time after a federal jury found him guilty on 13 counts of fraud and tax crimes today. The verdict follows a five-day trial that exposed a scheme to bilk the Defense Logistics Agency – the branch that supplies the U.S. military – out of over a million bucks.
Prosecutors laid out evidence showing Smith’s company, a defense contractor, delivered substandard goods while raking in payments. Jurors found Smith guilty of eight counts of wire fraud and five counts of failing to file corporate tax returns, effectively pocketing the ill-gotten gains without reporting a dime to the IRS between 2019 and 2023.
Smith could face up to 20 years on each of the wire fraud counts, plus hefty fines. The tax evasion charges carry a potential sentence of up to a year in prison and additional fines. Sentencing is pending.
The investigation was a joint effort by the Defense Criminal Investigative Service, IRS-Criminal Investigation, and the Naval Criminal Investigative Service.
