NEW YORK – New York Attorney General Letitia James today launched a legal assault on the Trump administration, filing suit to halt what she calls a “lawless” attempt to dismantle critical social safety nets for low-income families. The move comes after a recent, abrupt policy shift barring many programs from serving residents regardless of immigration status, a reversal decades in the making.
The lawsuit, joined by attorneys general from 20 other states, targets sweeping new directives issued earlier this month by the U.S. Departments of Health and Human Services (HHS), Education (ED), Labor (DOL), and Justice (DOJ). These agencies, acting on President Trump’s executive order, “Ending Taxpayer Subsidization of Open Borders,” have reinterpreted the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) of 1996, effectively restricting access to programs like Head Start, Meals on Wheels, child welfare, domestic violence shelters, and food banks.
“For decades, states like New York have built health, education, and family support systems that serve anyone in need,” Attorney General James stated bluntly. “These programs work because they are open, accessible, and grounded in compassion. Now, the federal government is pulling that foundation out from under us overnight, jeopardizing cancer screenings, early childhood education, primary care, and so much more. This is a baseless attack on some of our country’s most effective and inclusive public programs, and we will not let it stand.”
The core of the legal challenge centers on the administration’s redefinition of federally funded programs as “federal public benefits,” now subject to strict immigration verification. This change, implemented with minimal notice and bypassing public comment, impacts not only undocumented immigrants but also those with legal status – student visa holders, temporary workers, and exchange visitors. The AG’s office warns that even U.S. citizens and lawful residents could be wrongly denied services due to lack of proper identification.
The lawsuit alleges that the new policies are already causing significant disruption, with state programs facing the risk of losing federal funding. Providers, already stretched thin, are ill-equipped to implement the changes, potentially leaving vulnerable populations – children in foster care, domestic violence survivors, the homeless – without vital support. While some charitable organizations are exempt from the verification requirement, state and sub-grantee programs are not.
“This isn’t just bureaucratic overreach; it’s a deliberate attempt to punish immigrant communities and create chaos within essential social services,” a source within the Attorney General’s office told Grimy Times. “The administration is rushing to inflict harm, and we intend to hold them accountable.” The coalition is seeking a court order to halt the policies and prevent the collapse of these critical programs. The case is expected to be fiercely contested, marking another chapter in the ongoing legal battles between states led by Attorney General James and the Trump administration.
