NEW YORK – The streets of Queens ran red on July 4, 2024, and now, nearly a year later, New York Attorney General Letitia James’ Office of Special Investigation (OSI) has released its report on the death of Pedro Felix, ending the investigation into the NYPD officer-involved shooting. The report, released today, concludes that a prosecutor would be unable to secure a conviction against the officer who fired the fatal shot, deeming the use of force “justified” under New York law. But the details paint a brutal picture of a night gone horribly wrong.
According to the OSI report, NYPD officers responded to a frantic 911 call reporting an assault in progress at a Queens apartment. Arriving on the scene, officers were met with chaos – witnesses claiming a woman had already fled the apartment bleeding. Inside, they found Pedro Felix engaged in a violent struggle with another man, brandishing a knife. Repeated commands to drop the weapon were ignored, the report states, leading one officer to discharge their service weapon, striking and ultimately killing Felix.
The bloodshed didn’t end with Felix. An 8-year-old child was discovered within the apartment, suffering from multiple stab wounds. Despite desperate attempts to save him, the child succumbed to his injuries at a local hospital. Two additional witnesses also sustained stab wounds, receiving treatment and later being discharged. The scene was a tableau of unimaginable violence, a grim reminder of the dangers faced by both law enforcement and civilians alike.
The OSI report meticulously details the legal framework surrounding the officer’s actions. New York law allows officers to use deadly force when they “reasonably believe it to be necessary to defend against the use of deadly physical force by another.” Investigators reviewed body-worn camera footage, conducted extensive interviews with witnesses and involved officers, and performed a comprehensive legal analysis. The evidence, they concluded, supports the officer’s claim of acting in self-defense and to prevent further harm.
“Given the law and the evidence,” the report states, “a prosecutor would not be able to disprove beyond a reasonable doubt at trial that the officer’s use of deadly physical force against Pedro Felix was justified.” Two knives were recovered at the scene, further bolstering the justification for the officer’s actions. While the report offers legal closure, it does little to ease the pain for the families affected by this tragedy.
The OSI’s determination means no criminal charges will be pursued against the officer involved.
