Quentin Provancial II, a 31-year-old from Mission, South Dakota, is facing federal charges after allegedly attacking a tribal law enforcement officer and assaulting an intimate partner in October 2016. Indicted by a federal grand jury on December 13, 2016, Provancial stands accused of assaulting, resisting, opposing, and impeding a federal officer — a crime that carries a maximum sentence of 8 years in prison and a $250,000 fine.
The assault occurred on October 15, 2016, when Provancial allegedly attacked a law enforcement officer from the Rosebud Sioux Tribe while the officer was carrying out official duties. According to the indictment, he forcibly resisted, intimidated, and interfered with the officer during the encounter. The act triggered federal jurisdiction, elevating the charges under U.S. criminal code.
In the same incident, Provancial was also charged with Domestic Assault by an Habitual Offender — a felony charge due to his prior record. The indictment states that at the time of the assault, he had two prior final convictions for domestic abuse. This charge alone brings a maximum penalty of 5 years in federal custody, a $250,000 fine, and 3 years of supervised release.
Provancial appeared before U.S. Magistrate Judge Mark A. Moreno on December 29, 2016, where he entered a plea of not guilty to both counts. Each charge includes a mandatory $100 special assessment to the Federal Crime Victims Fund, and the court may also order restitution. He was remanded into the custody of the U.S. Marshals Service pending trial.
The investigation was led by the Rosebud Sioux Tribe Law Enforcement Services, highlighting the ongoing collaboration between tribal and federal authorities in prosecuting violent crimes on Native lands. Assistant U.S. Attorney Carrie G. Sanderson is handling the prosecution for the U.S. Attorney’s Office.
