MARTINSBURG, WEST VIRGINIA – Another link in the opioid pipeline has been severed. Brandi Kern, 22, of Harpers Ferry, West Virginia, admitted in federal court today to running a heroin distribution network, utilizing a simple telephone to peddle death across state lines. The case, pursued by the Department of Justice, highlights the insidious reach of the drug trade, even from seemingly small towns.
According to court documents, Kern’s operation wasn’t confined to her home state. She confessed to using her phone to coordinate heroin deals not only within Jefferson County, but also in the streets of Baltimore, Maryland, back in May of 2016. While the timeframe suggests a cold case, federal investigators clearly weren’t letting this one lie.
Kern pled guilty to one count of “Unlawful Use of Communication Facility” – a charge that, while sounding bureaucratic, effectively nails her for leveraging technology to facilitate a dangerous, illegal business. The potential consequences are significant: up to four years behind bars and a hefty fine reaching as high as $500,000.
The sentencing, however, won’t be a simple calculation. Acting United States Attorney Betsy Steinfeld Jividen stressed that the final decision will be based on a complex assessment of the severity of Kern’s actions and her prior criminal history, if any. Federal Sentencing Guidelines are notoriously intricate, offering a range of possible outcomes.
Assistant U.S. Attorney Anna Z. Krasinski led the prosecution, building the case with the combined efforts of the Federal Bureau of Investigation and the Eastern Panhandle Drug and Violent Crime Task Force. This task force, funded by the HIDTA (High Intensity Drug Trafficking Area) program, demonstrates the ongoing commitment of federal resources to combatting drug-related crime in the region.
U.S. Magistrate Judge Robert W. Trumble presided over the guilty plea.
