Martir Perdomo-Chavez, a 44-year-old citizen of Honduras, is back in federal crosshairs — charged with illegally reentering the United States after prior deportation, according to a January 26, 2023 indictment unsealed in New Orleans.
The charge, filed under Title 8, United States Code, Section 1326(a), alleges that Perdomo-Chavez was encountered inside the U.S. on or about January 5, 2023 — nearly 15 years after he was formally removed on June 11, 2008. Federal authorities say his return was unlawful and deliberate.
If convicted, Perdomo-Chavez faces up to two years behind bars, a $250,000 fine, one year of supervised release, and a mandatory $100 special assessment fee. The stakes are high, even for immigration-related offenses, and prosecutors are moving swiftly.
The case was investigated by the Department of Homeland Security’s Immigration and Customs Enforcement (ICE), the frontline agency in tracking down previously deported individuals who reenter the country without authorization. Their work led directly to Perdomo-Chavez’s identification and indictment.
U.S. Attorney Duane A. Evans, who announced the charges, credited ICE with precision and persistence. “This prosecution sends a clear message,” Evans said in a statement. “We are monitoring our borders and our communities — and we will act when immigration laws are violated.”
Assistant U.S. Attorney Spiro G. Latsis is leading the prosecution. Court records show no indication of legal representation for Perdomo-Chavez at this time. His next appearance is pending in the Eastern District of Louisiana.
