Brady James Claymore, a 37-year-old man from McLaughlin, South Dakota, has been sentenced to eight months in federal prison for Abusive Sexual Contact. The sentencing, which took place on July 8, 2024, was handed down by Charles B. Kornmann, U.S. District Court.
According to the U.S. Attorney’s Office, Claymore pleaded guilty to the charges on April 10, 2024, after being indicted by a federal grand jury in February of 2024. The incident occurred on the morning of December 3, 2023, when Claymore entered the bedroom of a 20-year-old woman and touched her thighs and intimate parts over her clothing without her consent.
The abuse ended when the woman told Claymore to leave her room. The incident took place in McLaughlin, South Dakota, which is located within the Standing Rock Sioux Indian Reservation. As a result, the case was prosecuted in federal court due to the Major Crimes Act, a federal statute that mandates certain violent crimes alleged to have occurred in Indian country be prosecuted in federal court.
The case was investigated by the Bureau of Indian Affairs – Office of Justice Services, and prosecuted by Assistant U.S. Attorney Carl Thunem. Claymore was immediately remanded to the custody of the U.S. Marshals Service after the sentencing.
In addition to the eight months in federal prison, Claymore was also ordered to pay a special assessment to the Federal Crime Victims Fund in the amount of $100. He will also serve five years of supervised release after completing his prison sentence.
The U.S. Attorney’s Office announced the sentencing, with United States Attorney Alison J. Ramsdell stating that the office is committed to prosecuting crimes that occur in Indian country. The sentencing of Brady James Claymore serves as a reminder that these crimes will be taken seriously and prosecuted to the fullest extent of the law.
