Carlos Benjamin Martinez, a 28-year-old man from Edinburg, Texas, has pleaded guilty to producing, receiving, and distributing child pornography—a case that exposed the brutal exploitation of a child barely older than a pre-teen. U.S. Attorney Kenneth Magidson confirmed the charges, which stem from a digital trail of depravity uncovered by federal investigators.
Martinez admitted to downloading and trading child pornography through email, including sending illicit images to a suspect under investigation in Massachusetts in March 2015. That probe led the FBI straight to Martinez, who had embedded himself in a network of predators. In September 2015, agents raided his home, seizing electronic devices that would later reveal thousands of images and multiple videos of young children subjected to sexually explicit acts.
Forensic analysis of his cell phone delivered the most damning evidence: a video of Martinez performing sexual intercourse on a minor child approximately 12 years of age. The footage, recorded on his own device, serves as irrefutable proof of his role not just as a consumer, but as a producer of child sexual abuse material.
The charges carry severe penalties. For the production count, Martinez faces a mandatory minimum of 15 years and up to 30 years in federal prison. On the counts of receipt and distribution, he could serve an additional five to 20 years and face a $250,000 fine. U.S. District Judge Randy Crane, who accepted the guilty plea, scheduled sentencing for February 9, 2017. Martinez remains in federal custody with no chance of bond.
Assistant U.S. Attorneys Alex Benavides and Kimberly Ann Leo are prosecuting the case, which was brought under Project Safe Childhood—a Justice Department initiative launched in 2006 to dismantle networks of child sexual exploitation. The FBI led the investigation, using digital forensics and interstate coordination to track the flow of illegal material and hold perpetrators accountable.
This case underscores the dark underbelly of online child exploitation, where predators like Carlos Benjamin Martinez operate in shadows—until law enforcement follows the data and drags their crimes into the light. As authorities work to identify victims and dismantle networks, Project Safe Childhood continues its mission: to rescue the abused, punish the guilty, and protect the vulnerable.
