Francisco Martinez-Rubio Gets 12.5 Years for Heroin Run

Francisco Martinez-Rubio, a 36-year-old Mexican national and California resident, is locked in for 12 and a half years after the Third Circuit Court of Appeals upheld his federal sentence for moving 23 kilograms of heroin—nearly 760,000 individual retail bags—across the country from California to Pennsylvania.

The U.S. Attorney’s Office for the Middle District of Pennsylvania confirmed the appellate decision, which rejected Martinez-Rubio’s claim that his 151-month sentence was excessive. The defendant had pleaded guilty on September 8, 2015, to possession with intent to distribute more than one kilogram of heroin, a charge carrying steep mandatory minimums under federal law.

Sentenced on December 15, 2015, by Senior U.S. District Court Judge Richard P. Conaboy, Martinez-Rubio admitted to participating in a multi-courier operation that transported the narcotics during a cross-country trek between late June and early July 2014. Court records show he didn’t just ride along—he recruited and directed others in the smuggling run, a fact central to the court’s sentencing enhancement.

The appeals court found that Judge Conaboy was justified in labeling Martinez-Rubio an organizer of criminal activity, a designation that significantly increased his sentencing exposure. The panel ruled the 12.5-year term was reasonable, citing the massive scale of the drug shipment and the urgent need to deter similar high-volume trafficking operations.

This case emerged from the Middle District’s Heroin Initiative, a coordinated crackdown targeting major suppliers fueling the opioid crisis. Spearheaded by U.S. Attorney Bruce D. Brandler, the initiative unites federal, state, and local agencies to dismantle distribution networks—an effort underscored by stiff penalties like the one handed to Martinez-Rubio.

Investigation was led by the Drug Enforcement Administration and the Pennsylvania State Police. Assistant U.S. Attorney Francis P. Sempa prosecuted the case and handled the successful appeal, reinforcing the government’s resolve to crush long-haul drug pipelines feeding addiction in communities across the region.
