WASHINGTON D.C. – The future of American citizenship hung in the balance today as the Supreme Court heard arguments regarding a nationwide injunction blocking former President Trump’s attempt to dismantle birthright citizenship. New York Attorney General Letitia James, leading a coalition of 19 other state attorneys general, forcefully defended the 14th Amendment against what they call a brazen power grab.
The case centers on Trump’s 2025 executive order attempting to redefine who qualifies as a U.S. citizen, specifically targeting children born to non-citizens within U.S. borders. The order, swiftly challenged in court, ignited a firestorm of legal battles, with numerous states arguing it’s a clear violation of the 14th Amendment’s citizenship clause. Today’s oral arguments represented a critical juncture in that fight.
“We were proud to stand together to defend birthright citizenship and the rule of law at the U.S. Supreme Court today,” James stated following the hearing. “For 127 years, the law has been clear: if you are born in this country, you are a citizen of the United States. Administrations of both parties have consistently respected that right ever since. As every court to have considered the policy agrees, the president’s attempt to end birthright citizenship is patently unconstitutional.”
The arguments before the Justices were reportedly contentious, with Trump’s legal team attempting to justify the executive order by claiming broad presidential authority over immigration and citizenship. They argued the president had the power to interpret the Constitution, a claim fiercely rebuffed by James and her colleagues. The coalition highlighted the potential chaos and disruption that would ensue if the order were allowed to stand, creating a two-tiered system of citizenship based on parental status and place of birth.
“The Trump administration’s argument before the Supreme Court today—that the president should be permitted to strip American citizenship from people based solely on the state in which they happen to be born—would upend settled law and produce widespread chaos and disruption,” James emphasized. “The president cannot rewrite the Constitution and contradict the Supreme Court’s own holdings with the stroke of a pen.”
Joining James in the fight are the attorneys general of Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, Washington, and the District of Columbia. The Supreme Court is expected to issue a ruling in the coming weeks, a decision that will have profound implications for millions of Americans and the very definition of citizenship in this country.
