Kevin DiMartino Arrested in Child Porn Probe

Kevin DiMartino, 37, of Greece, NY, is behind bars on federal child pornography charges, accused of receiving, distributing, and possessing vile material depicting the sexual abuse of children as young as five years old.

The arrest stems from a December 6, 2016, discovery by an undercover law enforcement officer who identified a video file containing child pornography linked to an email address registered to DiMartino. Investigators say the file wasn’t just uploaded—it was shared, with DiMartino making multiple images and videos available for download, including content showing the rape of toddlers and sex acts involving a 10-year-old and other minors.

In January 2017, federal agents and local police raided DiMartino’s home, executing a search warrant that yielded a desktop computer, an external hard drive, and a thumb drive. Forensic analysis uncovered approximately 23,000 images of child pornography and additional material classified as child erotica—evidence that prosecutors say paints a damning picture of deliberate, ongoing criminal activity.

DiMartino appeared before U.S. Magistrate Judge Marian W. Payson, where he was arraigned on the charges. Despite the severity of the allegations, he was released pending trial. He is scheduled to return to court for a status conference on March 9, 2017, at 9:30 a.m. in Rochester, N.Y.

The case is being prosecuted by Assistant U.S. Attorney Melissa M. Marangola and was brought by Acting U.S. Attorney James P. Kennedy, Jr. The investigation was led by the Federal Bureau of Investigation under Special Agent-in-Charge Adam S. Cohen, with critical support from the Greece Police Department, directed by Chief Patrick D. Phelan.

The charges against DiMartino carry a mandatory minimum sentence of five years in federal prison and a maximum penalty of 20 years for each count. Federal authorities stress that the complaint is merely an accusation—DiMartino is presumed innocent until proven guilty in a court of law.
