Kevin White, 28, of St. Francis, South Dakota, is accused of violently assaulting a federal officer during a confrontation on September 3, 2016, in what prosecutors are calling a brazen attack on federal authority. White, along with Frank Swalley, Jr., 33, of Mission, South Dakota, allegedly attacked the officer while he was performing official duties, using physical force to resist and impede law enforcement.
The federal grand jury indictment, unsealed October 12, 2016, charges both White and Swalley with Assaulting, Resisting, and Impeding a Federal Officer—a felony carrying a maximum penalty of 8 years in prison, a $250,000 fine, 3 years of supervised release, and a $100 payment to the Federal Crime Victims Fund. Both men appeared before U.S. Magistrate Judge Mark Moreno on October 19, 2016, and entered not guilty pleas.
Delores Schweigman-Long, 40, also of St. Francis, is charged with Accessory After the Fact. The indictment alleges she knowingly assisted Kevin White after the assault, providing comfort and aid to help him evade arrest, trial, and punishment. If convicted, Schweigman-Long faces up to 4 years in prison, a $120,000 fine, 1 year of supervised release, and a $100 penalty.
According to the indictment, White and Swalley acted in concert, aiding and abetting each other during the violent encounter. Their actions allegedly included physical resistance, intimidation, and interference with the officer’s lawful duties. The exact circumstances leading to the confrontation remain under investigation, but federal authorities stress the seriousness of attacking someone enforcing federal law.
The investigation was led by the Rosebud Sioux Tribe Law Enforcement Services, highlighting the complex jurisdictional realities on tribal lands. Assistant U.S. Attorney Carrie G. Sanderson is prosecuting the case for the U.S. Attorney’s Office, emphasizing the federal government’s commitment to protecting its officers even in remote jurisdictions.
All three defendants were released pending trial. No trial dates have been set. The charges are merely accusations, and Kevin White, Frank Swalley, Jr., and Delores Schweigman-Long are presumed innocent until proven guilty in a court of law.
