SAN DIEGO – Shantal Hernandez, a case manager tasked with overseeing complaints at the Otay Mesa Detention Facility, has been charged with sexually abusing a detainee. The allegations paint a grim picture of exploitation within the facility, revealing a betrayal of trust and a callous disregard for the vulnerability of those in custody.
Federal prosecutors allege Hernandez engaged in a sexual relationship with a detainee, identified only as I.K.N., while employed by the Office of the Immigration Detention Ombudsman (OIDO). The OIDO is supposed to be an independent body ensuring humane conditions within immigration detention centers – a role Hernandez allegedly violated in the most egregious way possible.
The case came to light after agents with the Department of Homeland Security’s Immigration and Customs Enforcement, Office of Professional Responsibility (ICE OPR) flagged an unusually close relationship between Hernandez and I.K.N. It wasn’t just proximity; investigators soon uncovered a trove of damning evidence. Phone records revealed a pattern of frequent and explicitly sexual conversations between the two, detailing an ongoing affair.
A search warrant executed on Hernandez’s electronic devices yielded even more incriminating proof. The feds discovered a video depicting one of the alleged sexual acts, solidifying the case against her. The evidence suggests a deliberate and sustained abuse of power, preying on a vulnerable individual within the detention system. Hernandez’s position granted her access and authority over I.K.N., creating an inherent imbalance of power she allegedly exploited.

Hernandez made her initial appearance in federal court and a detention hearing has been scheduled. She faces charges under Title 18, U.S.C., Section 2243(b), which specifically addresses the sexual abuse of a ward – someone in the defendant’s care or custody. If convicted, Hernandez faces a significant prison sentence. The investigation is ongoing, and the feds aren’t ruling out the possibility of additional charges or victims.
