Pasqual Francis Ortega Sentenced in Child Sex Abuse Case

Pasqual Francis Ortega, 35, of Mescalero, New Mexico, is going to federal prison for sexually assaulting a 13-year-old child on the Mescalero Apache Reservation. The enrolled tribal member pleaded guilty to the crime in a Las Cruces courtroom, admitting he engaged in a sexual act with the minor on July 6, 2019, when he was 34 years old.

Ortega was arrested on August 14, 2019, following a federal criminal complaint charging him with sexual abuse of a minor. With no trial, no excuses, he entered a guilty plea on November 25, 2019. In doing so, he confirmed under oath that the crime occurred within the jurisdiction of the Mescalero Apache Reservation, where federal law holds authority in major criminal cases.

Yesterday, the hammer came down. U.S. District Judge William P. Johnson sentenced Ortega to 41 months in federal prison, a term that will be followed by five years of supervised release. During that post-prison period, Ortega will be under constant watch — subject to unannounced checks, travel restrictions, and mandatory counseling.

He will also be required to register as a sex offender for life — a public record that marks him as a predator. That registry status follows him wherever he goes, broadcasting his conviction to communities, employers, and law enforcement across state lines.

The investigation was led by the FBI’s Las Cruces Resident Agency, with critical support from the Mescalero Agency of the Bureau of Indian Affairs’ Office of Justice Services. Coordination between federal and tribal law enforcement was key in building the case, highlighting the ongoing challenges of prosecuting violent crimes on Native lands.

Assistant U.S. Attorney Aaron O. Jordan of the U.S. Attorney’s Las Cruces Branch Office handled the prosecution. The case closed with a conviction, but the damage inflicted on the victim lingers far beyond courtroom timelines. Ortega is expected to report to prison within 60 days.
