Randy David May Indicted on Federal Firearm Charges

Randy David May, 36, of Franklin, West Virginia, is facing a federal indictment on multiple firearms violations stemming from an incident in Pendleton County on August 28, 2016. The charges were handed down by a federal grand jury, marking a significant escalation in a years-old case that has resurfaced with serious consequences.

May is charged with ‘Felon in possession of a firearm,’ ‘Possession of a firearm with altered serial number,’ and ‘Unlawful transfer of short barrel firearm.’ Each of these charges carries substantial penalties, including stiff prison time and fines. The allegations paint a picture of deliberate and illegal handling of dangerous weapons in direct violation of federal law.

For the first count, May faces up to ten years in prison and a fine of up to $250,000. The second count carries a maximum of five years in prison and a $250,000 fine. The third, ‘Unlawful transfer of short barrel firearm,’ could result in up to 10 years behind bars and a $10,000 fine. These penalties underscore the severity with which federal authorities treat illegal firearm activity.

The case is being prosecuted by Assistant U.S. Attorney Stephen D. Warner, who is leading the government’s efforts to hold May accountable. The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), the primary federal agency tasked with enforcing weapons laws and tracking illegal arms.

Acting United States Attorney Betsy Steinfeld Jividen confirmed the indictment, emphasizing that while charges have been filed, the legal process must now take its course. ‘An indictment is merely an accusation,’ Jividen stated. ‘A defendant is presumed innocent unless and until proven guilty.’

Under the Federal Sentencing Guidelines, the actual sentence May receives—if convicted—will depend on the seriousness of the offenses and any prior criminal history. As the case moves forward, federal prosecutors are expected to present evidence linking May directly to the weapons in question, setting the stage for a hard-fought courtroom battle.
