BOSTON – Oscar Lopez, 41, a Honduran national with a history of flouting U.S. immigration law, received a lenient sentence of time served – roughly 2.5 months – followed by a year of supervised release. However, the reprieve is temporary. U.S. District Court Chief Judge F. Dennis Saylor IV made it clear: Lopez is subject to deportation once his sentence is complete. The case underscores the ongoing struggle to control unlawful reentry, particularly for individuals repeatedly removed from the country.
Lopez, who also goes by the alias “Luis Maldonado,” pleaded guilty in May 2025 to one count of unlawful reentry. The charge stems from his persistent attempts to evade deportation orders and re-establish residence in the United States despite being previously expelled. This wasn’t a simple overstay; it was a deliberate pattern of disregard for federal law, authorities say.
The saga began in 2003 when Lopez illegally entered the United States. He skipped an immigration court date that same year and was subsequently ordered removed. However, Lopez went underground, evading authorities for nearly a decade. It wasn’t until the fall of 2012 that Immigration and Customs Enforcement (ICE) located him, leading to his removal in January 2013. The brief respite didn’t last. Just months later, in May 2013, Lopez was caught illegally reentering the U.S. again, resulting in a second removal.
Despite the second deportation, Lopez once more managed to slip back into the country. His unlawful presence resurfaced in March and April 2024 when he was arrested by state authorities in Brockton for operating a motor vehicle without a license and providing false identification to law enforcement. These seemingly minor offenses ultimately led to his re-arrest by ICE in April 2025 and the current federal prosecution. The false ID charge suggests a calculated effort to conceal his identity and avoid detection.
United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director for ICE’s Enforcement and Removal Operations in Boston, jointly announced the sentencing. They emphasized the importance of enforcing immigration laws and holding accountable those who repeatedly violate them. Assistant U.S. Attorney John J. Reynolds of the Criminal Division handled the prosecution, building a case based on Lopez’s documented history of unlawful reentry.
While Lopez received a relatively short sentence, the looming deportation serves as a clear message: repeated unlawful reentry carries serious consequences. Whether this will finally deter Lopez remains to be seen. ICE officials confirm they will be ready to execute the deportation order as soon as legally permissible, sending Lopez back to Honduras – hopefully for good.
