CLEVELAND, OH – Andrea J. Smiley, 35, of Cleveland, will spend the next six months behind bars after being sentenced for a brazen scheme to siphon over $35,000 in Social Security benefits intended for her disabled son. U.S. Attorney Carole S. Rendon announced the sentence today, a small victory in a system riddled with exploitation.
Smiley was found guilty of theft of government property after investigators uncovered a calculated pattern of deception. She acted as the representative payee for her minor son, who received Social Security disability benefits. However, the boy entered the custody of the Cuyahoga County Department of Child and Family Services back in March 2011 – a fact Smiley conveniently failed to disclose to the Social Security Administration.
Court documents detail how Smiley filed four false annual reports, each claiming her son still resided with her and that the benefits were being used for his legitimate care. This was a blatant lie. From April 2011 through May 2015, Smiley systematically pocketed $35,279 in SSA benefits, diverting funds meant for a vulnerable child to her own personal use. The scheme wasn’t sophisticated, just persistent and callous.
The fraud finally unraveled, leading to an investigation by the Social Security’s Office of the Inspector General. The evidence painted a clear picture of a mother prioritizing her own needs over the well-being of her son. While six months is a relatively light sentence, it sends a message – however weak – that stealing from the vulnerable won’t be tolerated.
In addition to the prison term, Smiley was ordered to repay the entire $35,279 to the Social Security Administration. Whether she’ll actually be able to fulfill that obligation remains to be seen. This case was prosecuted by Special Assistant U.S Attorney Lisa J. Sanniti, who built a solid case against Smiley based on meticulous documentation and investigative work.
