The indictment details a calculated operation where Brooks allegedly opened an account at Urban Trust Bank under the guise of “Magnificent Tax Services.” Despite possessing a valid tax preparer number, Brooks didn’t bother with legitimate tax preparation. Instead, she exploited taxpayers with a fraudulent “permission” form, claiming authorization to deposit and cash their third-party tax refund checks into her account – all while skimming a hefty “service charge” of up to 25 percent.

According to federal prosecutors, Brooks didn’t remit any of the stolen funds to the rightful taxpayers. The money, totaling a staggering $327,521, was allegedly used for personal expenses. The United States is now seeking a money judgment for the full amount, aiming to recoup the ill-gotten gains.

The scheme relied on deceiving both taxpayers and the system, using a flimsy “permission” form to justify the theft of funds that were intended for others. Investigators from the Internal Revenue Service – Criminal Investigation and the Manatee County Sheriff’s Office worked together to unravel the fraudulent activity and bring the charges against Brooks.

If convicted on the wire fraud count, Brooks faces a maximum sentence of 20 years in federal prison. The aggravated identity theft charge carries a mandatory consecutive sentence of two years, stacking the potential penalty to a lengthy 22-year stretch. The indictment serves as a clear warning that tax fraud and identity theft will not be tolerated.
