TAMPA, FLORIDA – Daniel Weatherly, 42, of Brownwood, Texas, is headed to federal prison after being sentenced today for a sickening crime. U.S. District Judge Thomas P. Barber handed Weatherly a two-year sentence for possession of an obscene visual depiction of a minor engaging in sexually explicit conduct. The sentence isn’t nearly enough for the damage he inflicted, but it’s a start.
Court documents reveal a disturbing level of depravity. Weatherly utilized an application on his cellphone to generate images depicting the sexual abuse of children. This wasn’t accidental exposure; Weatherly deliberately crafted prompts, specifying age ranges between five and eight years old, and detailing the exact acts he wanted visualized. He didn’t stumble upon this material – he created it.
The details are intentionally vague, and rightly so. The specifics of Weatherly’s requests are too horrific to repeat. What’s clear is that he actively sought out and possessed this material, fueling a monstrous demand. This case highlights the evolving nature of this depraved industry, and the lengths predators will go to satisfy their urges. Weatherly pleaded guilty on January 8, 2025, a small step towards accountability.
Beyond the prison sentence, Weatherly will serve three years of supervised release upon his release. Critically, the court has also mandated no contact with minors. This is a vital component of the sentence, attempting to prevent further harm. But supervision alone isn’t a guarantee, and the potential for recidivism remains a serious concern.
The Federal Bureau of Investigation led the investigation, with significant assistance from the North Port Police Department. Assistant United States Attorneys Erin Claire Favorit and Abigail K. King prosecuted the case, working tirelessly to bring Weatherly to justice. This case is part of Project Safe Childhood, a nationwide initiative launched in 2006 to combat the escalating epidemic of child sexual exploitation and abuse. The initiative, led by the Department of Justice, aims to dismantle these networks and protect the most vulnerable among us.
Project Safe Childhood marshals resources at the federal, state, and local levels to locate, apprehend, and prosecute offenders, and to rescue victims. It’s a constant battle, a grim reminder of the darkness that exists. If you have information regarding child exploitation, report it immediately. Resources and more information can be found at www.justice.gov/psc. Don’t look away. These children deserve our protection.
