Zalewski Death: No Charges for Officer in Dewitt Crash

New York – The grim tale of Steven Zalewski’s tragic death has concluded with a resolution. On October 9, 2023, the life of Zalewski was cut short in a collision with Dewitt Police Department (DPD) Officer. Now, New York Attorney General Letitia James’ Office of Special Investigation (OSI) has exonerated the officer, declaring no criminal charges will be filed.

The OSI report revealed that the investigation, which spanned over months, included a meticulous review of reports, interviews, and body-worn camera footage. The conclusion was clear: there was insufficient evidence to prove beyond a reasonable doubt that the officer caused Zalewski’s death or committed any crime.

That evening, as Officer responded to a call, he traveled at 28 MPH on Bridge Street, within the speed limit but over the median where Zalewski lay. The OSI noted no evidence suggesting the officer was impaired by drugs or alcohol, nor did his body-worn camera reveal any distractions.

Despite toxicology reports indicating the officer was on prescription medication, OSI found no link between this and the incident. However, OSI recommended that all patrol officers undergo training in the administration of Portable Breath Tests (PBTs) to ensure accurate results post-accident.
