Micheal Guzman, $4M Employer Fraud, North Carolina 2023

A Denver, North Carolina man has been sentenced to 4.5 years in prison for defrauding his former employer of more than $4 million.

Micheal Guzman, 43, was sentenced to 54 months in prison and two years of supervised release for his role in the scam, according to the U.S. Attorney’s Office for the Western District of North Carolina.

Guzman was also ordered to pay $4.1 million in restitution. He pleaded guilty to wire fraud and money laundering in 2021 and will begin serving his sentence at a federal facility.

According to court records, Guzman executed a scheme to defraud his employer, Company A, between June 2019 and May 2020. During this time, he auctioned off approximately 398 assets of Company A through an online auction house, representing that they were owned by his shell companies.

Guzman was able to hide the scheme from his employer by manipulating internal company records. The proceeds of the sales were sent to a bank account under his control, which he used to purchase a condominium in South Carolina, a plot of land in New York, an RV vehicle, a boat, and multiple cars and trucks.

U.S. District Judge Kenneth D. Bell handed down the sentence, and Guzman is set to report to the federal Bureau of Prisons upon designation of a federal facility.

The U.S. Attorney’s Office for the Western District of North Carolina thanked the Federal Bureau of Investigation (FBI) for their investigation into the case.

Assistant U.S. Attorney Maria Vento prosecuted the case, which was announced by Acting U.S. Attorney William T. Stetzer and Special Agent in Charge of the FBI’s Charlotte Division, Robert R. Wells.
