NEW YORK – The Trump administration is holding over $10 billion in federal funding hostage, threatening to cripple vital support programs for low-income families in New York, California, Colorado, Illinois, and Minnesota. New York Attorney General Letitia James today launched a legal assault, leading a coalition of four other states in a lawsuit aimed at forcing the administration to release the frozen funds.
The Administration for Children and Families (ACF) abruptly announced the freeze January 5th and 6th, targeting three critical programs: the Child Care and Development Fund (CCDF), Temporary Assistance for Needy Families (TANF), and the Social Services Block Grant (SSBG). James and her fellow attorneys general argue the move is illegal and designed to punish states – and the vulnerable families they serve – for political reasons. The suit demands a court order declaring the freeze unlawful and preventing its implementation.
“Once again, the most vulnerable families in our communities are bearing the brunt of this administration’s campaign of chaos and retribution,” Attorney General James stated bluntly. “After jeopardizing food assistance and health care, this administration is now threatening to cut off childcare and other critical programs that parents depend on to provide for their children. As New Yorkers struggle with the rising cost of living, I will not allow this administration to play political games with the resources families need to help make ends meet.”
In New York alone, the impact could be devastating. The state receives over $2.4 billion in TANF funds, providing direct cash assistance to over 200,000 families to cover basic needs like housing and food. Grant Year 2025 saw $638 million in CCDF funds allocated to childcare for low-income families, and another $93 million flowed through the SSBG to support foster care, childcare, and protection services for vulnerable adults. The loss of these funds will ripple through the state’s social safety net.
The lawsuit alleges the administration has offered no credible justification for the freeze. Letters citing “potential” fraud are backed by zero evidence, according to James. The Attorney General contends the administration is ignoring established legal procedures for imposing sanctions and trampling on Congress’s authority over spending. The action is a blatant power grab, she argues, and a clear violation of the constitutional principle of separation of powers.
If the freeze holds, the consequences will be far-reaching. Parents will be forced to choose between work and safe childcare, childcare facilities will shutter, and the economies of these states will suffer. James and the coalition are seeking immediate court intervention to prevent a humanitarian crisis and protect the families who rely on these essential programs.
