The encounter took a dire turn when Mr. Novakowski, reportedly armed with scissors, failed to comply with an officer’s order to drop the weapon. The trooper then discharged his service weapon, resulting in Mr. Novakowski’s death at the scene. A woman involved in the dispute sustained minor injuries.
The OSI is mandated by New York State Executive Law Section 70-b to assess such incidents where police or peace officers may have caused a civilian’s death through action or inaction.
