New York – In a stunning revelation of financial chicanery, the Office of the New York Attorney General (NY AG) has filed a lawsuit against Capital One N.A. and Capital One Financial Corporation for misleading customers out of millions in interest payments. The allegations center on Capital One’s secret creation of a two-tier savings account system to avoid paying higher rates to existing customers.
The suit asserts that while Capital One advertised its “360 Savings” accounts as offering top interest rates, the bank maintained artificially low rates despite national interest rate hikes. To skirt paying millions in additional interest, Capital One introduced a nearly identical product called “360 Performance Savings,” with interest rates over 14 times higher than the standard account. Customers were kept in the dark about this new, superior option.
“New York families work hard to save money for their futures, and they deserve every dollar of interest they are promised,” said Attorney General Letitia James. “Capital One’s actions are a betrayal of trust that must be addressed.”
The lawsuit further claims that Capital One instructed employees not to inform 360 Savings customers about the new higher-interest account unless explicitly asked, effectively hiding its own product from those who were eligible for better rates. The bank also removed the 360 Savings information from its website and replaced it with 360 Performance Savings without disclosing their difference.
With compound interest at play, even a small difference in rates can lead to significant losses over time. A customer who put $10,000 in a 360 Savings account lost out on substantial interest by not being informed of the higher-rate option. This lawsuit seeks to rectify this injustice and hold Capital One accountable for its deceptive practices.
Attorney General James vowed to protect New Yorkers from such fraudulent tactics, emphasizing that “big banks are not allowed to cheat their customers with false advertising and misleading promises.” With this lawsuit, the NY AG aims to make amends for consumers who were misled by Capital One’s bait-and-switch scheme.
