NY AG: Home Utility Rights Reinforced as Winter Nears

New York – As the chill of winter begins to grip the Empire State, New York Attorney General Letitia James has issued a sharp consumer alert, reminding residents of their hard-fought home utility rights. The alert comes as the mercury plummets and residents brace for the cold.

“New Yorkers have a legal right to heat and hot water services during the winter season,” AG James declared. “With temperatures dropping, it’s vital that all New Yorkers are aware of their protections.”

The alert outlines key rights, including utilities’ obligations to make extra efforts before shutoffs occur (November 1 through April 15), a mandatory 35-day wait after notices go past due before termination can be pursued, and the prohibition of service interruptions during the holiday period surrounding Christmas and New Year’s Day.

AG James emphasized that trained personnel must assess health or safety risks before terminating service and that social services are to be notified when such risks exist. Any resident experiencing unauthorized shutoffs or mistreatment is encouraged to file a complaint online or call 1-800-771-7755.

The Department of Public Service’s website offers further details on the Energy Affordability Program and the Home Energy Fair Practices Act, providing additional support for New York residents.
