New York – A stunning turn of events in the tragic case of Tanja Foster, who lost her life following an encounter with the NYPD. The Office of Special Investigation (OSI) under New York Attorney General Letitia James today cleared the officer involved in the incident of any criminal wrongdoing.
Foster, 28, died on November 20, 2024, after being struck by an unmarked NYPD vehicle responding to a call for help. The OSI report cited a thorough review of body-worn and security camera footage, as well as interviews with the officer and witnesses. Despite the officer exceeding the speed limit, the evidence failed to prove beyond a reasonable doubt that the officer’s actions led to Foster’s death.
The investigation revealed that Foster fell into the road at 6:07 p.m., while the officer approached at 20 mph over the posted limit. The OSI determined that speeding alone was not sufficient grounds for criminal charges of criminally negligent homicide, especially given the visibility challenges in night-time conditions with streetlights and vehicle headlights.
Under New York law, proving criminally negligent homicide requires demonstrating a gross deviation from reasonable care that led to death due to failure to perceive a substantial risk. The OSI concluded there was insufficient evidence to support such a charge against the officer.
The family of Tanja Foster has expressed disappointment with the findings, demanding further scrutiny and investigation. Meanwhile, the NYPD stands by the officer who remains on duty pending an internal review.
