SHERMAN, Texas – The grim reaper of justice has come calling for a Collin County couple. John Mitchell Rutoskey, 59, and Gwenice Rutoskey, 54, were arrested early this morning at their McKinney home in a no-frills operation led by the feds. Today, the Eastern District of Texas U.S. Attorney John M. Bales dropped the hammer with an arrest for health care fraud violations.
The Rutoskeys were indicted on Dec. 12, 2012, by a federal grand jury, charged with conspiracy to commit healthcare fraud, six counts of actual fraud, causing false representations to federal healthcare programs, and two counts of money laundering. They’re due in court today before U.S. Magistrate Judge Amos Mazzant.
For each count of health care fraud and money laundering, the Rutoskeys face up to a decade behind bars. The charge of causing false representations in relation to federal healthcare programs could land them five more years.
This sordid case has been a joint effort by the Federal Bureau of Investigation, the Department of Health and Human Services, the Texas Attorney General’s Office, and McKinney Police. Assistant U.S. Attorney James Peacock is the prosecution pitbull on this case.
The feds are still fishing for more. Anyonewith inside info on healthcare fraud violations can drop a tip at 1-800-HHS-TIPS (447-8477).
Remember, a grand jury indictment is not proof of guilt. The Rutoskeys maintain their innocence until proven otherwise in court.
