Joseph Edmond Cleveland, a 25-year-old active-duty Army soldier from El Paso, has been sentenced to 15 months in federal prison for smuggling two illegal aliens through a U.S. Border Patrol checkpoint in Falfurrias, Texas. The conviction marks a stunning fall from duty for a man sworn to protect the nation’s borders.
Cleveland pleaded guilty on November 29, 2016, and was sentenced today by Senior U.S. District Judge Janis Graham Jack, who cited aggravating factors including Cleveland’s attempt to use his military status to evade detection. He will serve three years of supervised release following his prison term, as federal authorities send a clear message: no badge or uniform grants immunity from justice.
Cleveland and co-defendant Marco Antonio Nava Jr., 20, also of El Paso, admitted they were paid $1,500 by an unknown man to transport two undocumented immigrants from the Rio Grande Valley to Houston. On June 19, 2016, the pair drove the aliens through the Falfurrias checkpoint, hiding them in the rear passenger seats of their vehicle — a route notorious for smuggling runs.
At the checkpoint, a Border Patrol agent asked one passenger if he had legal documents. He said no. Both were quickly confirmed as unlawfully present in the U.S. and taken into custody. According to their statements, the men had crossed into the country eight days earlier and were shuttled between two trailer homes before being told a ride was coming to take them to Houston.
Inside the vehicle, Nava was driving and directed the passengers where to sit. Both illegal aliens said they were coached on what to say — or not say — if questioned by agents. The scheme unraveled in seconds under routine inspection, exposing a calculated breach of national security by a man in uniform.
Cleveland was allowed to remain on bond and will voluntarily surrender to the U.S. Marshals Service at a date yet to be determined. Nava, who also pleaded guilty, awaits sentencing. The case was investigated by Homeland Security Investigations and prosecuted by Assistant U.S. Attorney Jeffrey S. Miller.
