BLUFFS, IA – Council Bluffs Senior United States District Court Judge James E. Gritzner meted out a severe punishment on May 10, 2017, when he sentenced 25-year-old Brandon David Kinnear to 120 months in prison for his illegal possession of a firearm.
Kinnear’s crime spree reached its peak on August 30, 2016. The Omaha resident was caught with the grip of a .22 caliber semi-automatic handgun sticking out above his waistband while strolling along Carter Lake, Iowa. His prior felony drug conviction in South Dakota had stripped him of the right to own or possess firearms.
United States Attorney Kevin E. VanderSchel announced Kinnear’s sentence after he pleaded guilty on January 19, 2017. The investigation was a collaborative effort between the Carter Lake Police Department, the Council Bluffs Police Department, and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Prosecution for this case fell under the jurisdiction of the United States Attorney’s Office for the Southern District of Iowa, ensuring that justice was served in accordance with federal laws.
