MIDLAND, TX – Delma Vitela, 45, of Odessa, Texas, learned Wednesday that love isn’t a defense in federal court. She was sentenced to 18 months in prison after pleading guilty to providing false statements during multiple firearm purchases. Vitela’s actions directly armed a prohibited individual and funneled weapons across the border, potentially into the hands of dangerous Mexican cartels.
Court records show that between December 2020 and March 2022, Vitela purchased at least six firearms from gun stores in the Midland/Odessa area. These weren’t for her. She was acting as a “straw purchaser” for her then-boyfriend, a Mexican national legally barred from owning firearms due to his immigration status. Vitela repeatedly lied on federal forms, claiming she was the true buyer when she knew full well the guns were intended for someone else.
The scheme unraveled in March 2022 when law enforcement in Laredo, Texas, intercepted an individual attempting to cross into Nuevo Laredo, Mexico. In his possession were two firearms that Vitela had illegally purchased – one just two weeks prior. This wasn’t a simple oversight; it was a deliberate attempt to circumvent U.S. gun laws and supply weapons south of the border.
Vitela was arrested by federal authorities on October 21, 2022, and released on bond five days later. But the courtroom offered no reprieve. U.S. Attorney Jaime Esparza for the Western District of Texas minced no words, stating Vitela’s “conduct posed a serious threat to the safety and security of people in our communities on both sides of the U.S./Mexico border.”
“Straw purchasing is not an act of love; it is an act that fuels violence across our country and our neighbors,” declared Jeffrey C. Boshek II, Special Agent in Charge for the ATF Dallas Field Division. Boshek’s statement was blunt: Vitela wasn’t helping a boyfriend, she was “helping to arm vicious Mexican drug cartels.” The ATF investigated the case, and Assistant U.S. Attorney Joe Mahoney secured the conviction.
The 18-month sentence sends a clear message: those who facilitate illegal gun trafficking, even under the guise of affection, will face serious federal consequences. The Permian Basin, and the border itself, remain a key focus for the ATF, which vows to continue its relentless pursuit of those who attempt to arm criminals with illegally obtained firearms. This case underscores the deadly link between domestic straw purchasing and international violence.
