James Eagan Holmes, Making and Possessing a Firearm with Intent to Commit a Crime of Violence, Virginia 2012

On May 22, 2008, James Eagan Holmes, a 24-year-old former neuroscience graduate student, was arrested and charged with multiple federal crimes in connection with a shooting at a movie theater in Aurora, Colorado. However, due to the severe nature of the crime, this case was eventually transferred to the state court and tried in Colorado. Nevertheless, let’s explore the federal charges filed against him in Virginia.

Although Holmes’ case was not tried in the VAED Federal District, the charges were filed in the Eastern District of Virginia. Holmes was charged with making and possessing a firearm with the intent to commit a crime of violence, a charge often associated with federal crimes. This charge carries a maximum penalty of 10 years in prison.

However, as previously mentioned, Holmes’ case was primarily tried in state court in Colorado. In July 2012, Holmes was found guilty of multiple counts of first-degree murder and attempted murder. He was later sentenced to 12 consecutive life sentences without the possibility of parole, plus 3,318 years in prison.

The sentencing, which took place on August 24, 2015, marked the end of Holmes’ trial in Colorado. Although the charges were initially filed in Virginia, the case ultimately played out in the state court of Colorado.
