MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma has announced a grim milestone in their criminal justice efforts. Austin Dean McMahan, 24, of Okmulgee, was handed a 50-year sentence on each of two counts of Second Degree Murder in Indian Country, with the terms to be served concurrently.
The case stems from a shocking incident on April 7, 2020, when McMahan, amidst an argument at an Okmulgee residence, shot and killed his first victim. Unrelenting in his violence, McMahan then fired upon a second victim who attempted to intervene, only to be met with a gun that jammed. Undeterred, he acquired another firearm and opened fire multiple times, ultimately taking the second life. The tragic event unfolded within Okmulgee County, on the Muscogee (Creek) Nation Reservation in the Eastern District of Oklahoma.
McMahan pleaded guilty to the charges of Murder in Indian Country-Second Degree on February 16, 2023. The investigation was a collaborative effort between the Federal Bureau of Investigation, Okmulgee Police Department, and Okmulgee County Sheriff’s Office.
The sentencing hearing was presided over by U.S. District Judge Ada E. Brown, who sat by assignment in the Northern District of Texas. McMahan will be transported to a federal prison facility upon completion of his sentence, where he will serve a non-paroleable term.
Representing the United States at sentencing were Trial Attorney Cesar Rivera-Giraud from the U.S. Department of Justice Organized Crime and Gang Section, and Assistant United States Attorney Ryan Bondura. McMahan remains in custody of the U.S. Marshal until his transport to begin his sentence.
