BUFFALO, N.Y. – Two Guatemalan nationals are behind bars after a routine border check turned up a tangled web of prior deportations and repeated attempts to circumvent U.S. immigration law. Hugo Lopez Morales, 48, and Martin Lopez Morales, 30, were arrested and charged with illegal re-entry into the country, a crime carrying a maximum penalty of two years in prison and a $250,000 fine.
The bust unfolded August 16, 2025, at the Lewiston Bridge Port of Entry in Lewiston, NY. According to federal prosecutors, Hugo Lopez Morales was at the wheel of a vehicle packed with five passengers, including Martin Lopez Morales. None of the occupants possessed valid U.S. entry documentation, immediately raising red flags for Customs and Border Protection (CBP) officers. A secondary inspection quickly revealed a history of immigration violations for both men.
The situation is significantly more complex for Hugo Lopez Morales. He isn’t just a repeat offender; he’s a repeat convicted offender. Prosecutors have added a charge of illegal re-entry of a previously deported alien following a felony conviction, bumping his potential sentence up to a decade behind bars. Records show Lopez Morales was physically removed to Guatemala in November 2016, then illegally returned, was convicted of illegal reentry in June 2023, and deported *again* in August 2023. Even further back, he voluntarily returned to Mexico from the United States in both July 1998 and December 2004 – a clear pattern of disregard for U.S. law.
Martin Lopez Morales’s record isn’t clean either. He was physically deported to Guatemala in October 2020, and previously given voluntary returns to Mexico in April 2001 and twice in May 2021. While he hasn’t faced a criminal conviction for re-entry previously, his repeated attempts to bypass legal immigration channels have landed him in federal custody.
Both men appeared before U.S. Magistrate Judge H. Kenneth Schroder, Jr. and were ordered detained pending further legal proceedings. Special Assistant U.S. Attorney Michael J. Smith is prosecuting the case, which stems from an investigation conducted by Customs and Border Protection, under the direction of Director of Field Operations Rose Brophy. The agency has been stepping up border security in the region, and this case appears to be a direct result of those efforts.
It’s crucial to remember that these are merely charges, and both Hugo Lopez Morales and Martin Lopez Morales are presumed innocent until proven guilty in a court of law.
