ALBUQUERQUE – Daniel Roy Nard, 37, of Albuquerque, has copped to a federal charge after he failed to update his sex offender registration. The 2007 child pornography conviction in Montana that landed him on the registry became his undoing as he was nabbed for failing to keep his Bernalillo County records current.
Nard, who was indicted on December 17, 2015, has admitted to violating the Sex Offender Registration and Notification Act (SORNA), a federal law known as the Adam Walsh Protection and Safety Act. The act demands that sex offenders register in every jurisdiction they reside, work, or study in.
According to court documents, Nard was required to update his registration by October 30, 2015, but failed to do so. He now faces a maximum penalty of ten years in federal prison for this offense. Following his sentence, he will be compelled to maintain his sex offender status.
The grim details of the case were laid out during today’s proceedings, with Nard pleading guilty without the aid of a plea agreement. A sentencing hearing has yet to be scheduled, but it is clear that Nard’s failure to comply with SORNA’s stringent requirements will cost him dearly.
This investigation was a joint effort by the U.S. Marshals Service and the Bernalillo County Sheriff’s Office, while Assistant U.S. Attorney Jon K. Stanford will handle the prosecution.
