Aneva Gym Faces Lawsuit Over Deceptive Practices

New York — In a scathing lawsuit filed by Attorney General Letitia James, Aneva Gym in Long Island City faces accusations of misleading its customers and violating state laws designed to protect health club patrons.

The complaint alleges that Aneva Gym, operating as Atlas Risen Corp., did not provide customers with written membership contracts as required by law. Instead, the gym posted terms on its website that were in direct violation of New York’s Health Club Services Act.

‘When New Yorkers join a gym, they deserve clear contracts and the ability to cancel memberships without hassle,’ said Attorney General James. ‘Aneva Gym has failed to comply with our laws, and we are determined to right this wrong for their customers.’

The lawsuit further claims that Aneva Gym implemented illegal policies, such as requiring in-person cancellation notices when law allows for it to be done via various means, including email or mail. Additionally, the gym demanded a 30-day advance notice for cancellations, which contradicts the state’s three-business-day rule following renewal.

Attorney General James is seeking restitution for affected customers, the cancellation of all illegal membership agreements, disgorgement of profits, and penalties to deter future violations. Attorney General James has a track record of protecting consumers from deceptive practices, previously securing $600,000 for New Yorkers facing difficulties cancelling Equinox memberships and recovering $4.8 million for SmileDirectClub customers following bankruptcy.
