New York Attorney General Letitia James has struck a blow for consumer rights by securing refunds and policy changes from Aneva Gym, a Queens-based fitness center accused of misleading customers with illegal cancellation policies.
In June 2025, the AG’s office filed a lawsuit against Aneva Gym, located in Long Island City, for not providing written membership contracts as required by state law. The gym also imposed cancellation requirements that went against New York’s Health Club Services Act, including demanding customers cancel memberships in writing and in person, rather than allowing cancellations via email or phone.
The investigation revealed further violations, such as Aneva Gym requiring members to cancel 30 days ahead of time, whereas the law allows for cancellation within three business days after renewal. Additionally, the gym failed to secure a legally mandated $50,000 bond with the Department of State to protect consumers in case of closure or service failure.
As a result of the lawsuit, Aneva Gym has agreed to revise its policies to align with state laws. The gym will provide refunds and restitution to customers who were affected by these illegal practices and has paid a $5,000 penalty. Attorney General James emphasized the importance of clear contracts and easy cancellation processes for consumer protection.
James’ office encourages any former Aneva Gym members facing difficulty canceling their memberships to file a complaint online or call the AG’s hotline at (800) 771-7755. She also advises consumers to check whether health clubs have posted the necessary financial security before joining.
