LONG ISLAND CITY, NY – Atlas Risen Corp., doing business as Aneva Gym, is in the crosshairs of New York Attorney General Letitia James, accused of systematically misleading customers and violating state laws designed to protect health club members. The Attorney General’s office alleges a pattern of deceptive practices, including a refusal to provide basic written contracts and the implementation of deliberately obstructive cancellation policies.
The lawsuit, filed today, June 13, 2025, details how Aneva Gym, which opened its doors in 2022, skirted New York’s Health Club Services law. Instead of providing legally required written contracts, the gym posted terms and conditions online – terms that, according to the Attorney General, actively violate consumer protections. The gym’s cancellation policies are particularly egregious, demanding written requests delivered in person when the law explicitly allows cancellations via website, email, mail, or phone.
“When New Yorkers join a gym, they deserve clear contracts that allow them to cancel their memberships quickly and easily,” Attorney General James stated bluntly. “No one should have to struggle to get out of an expensive subscription. Aneva Gym failed to follow our laws that protect consumers, and my office is determined to get justice for their customers.” The OAG also discovered that Aneva Gym failed to post a legally mandated $50,000 bond with the New York Department of State, a financial safeguard for consumers should the gym shutter or fail to deliver promised services.
The Attorney General’s office is seeking significant penalties: restitution for affected customers, a complete voiding of all unlawful membership agreements, disgorgement of profits illegally obtained, and additional financial penalties. This isn’t James’s first rodeo with predatory gym practices; in May, she secured $600,000 from Equinox for similar membership cancellation issues. December 2024 saw a $4.8 million recovery for over 28,000 SmileDirectClub customers improperly charged after the company’s bankruptcy.
James has consistently targeted subscription service abuses, suing SiriusXM in December 2023 for trapping customers in unwanted subscriptions, and winning a court decision in November 2024 confirming SiriusXM’s illegal cancellation processes. In 2021, she also secured restitution from New York Sports Clubs and Lucille Roberts for unlawful billing and cancellation practices during the COVID-19 pandemic. This case demonstrates a clear pattern of holding businesses accountable for exploiting consumers.
The case is being prosecuted by Assistant Attorney General Melvin Goldberg of the Consumer Frauds & Protection Bureau, supervised by Bureau Chief Jane M. Azia and Deputy Bureau Chief Laura J.
